Escheat, in general, refers to the reversion of property to the government when there is no clear owner. This can happen in various situations, including to a property owner who passes away intestate.


When someone dies without a will and has no known heirs, their property may escheat to the state. This ensures the property doesn't remain abandoned and ownerless.

Eminent domain is the power of the government to take private property for public use, with just compensation - fair market value - provided to the owner. This power is granted by the Fifth Amendment of the US Constitution and exists similarly in many other countries under different names.
